Warranty for Roll-off Containers

Bucks™ Fabricating warrants to the original Buyer that the manufactured products are free of defects in material and workmanship for a period of one year; Lifetime guarantee on hook plate and hook.  Products are NOT guaranteed against damage by destructive loading, hauling, handling or unloading.  Products are NOT guaranteed against wearing out.  If Buyer notifies Bucks™ within 12 months after purchase of any such defects and returns the products to Bucks™ at Buyer’s sole expense, Bucks™ shall, at its option, repair the products or replace them with products of comparable value. In either case, the Warranty Period for the repair or replaced products shall extend after the date of repair or replacement for a time equal to the original Warranty Period.  If Buyer does not notify Bucks™ of such defects, whether patent or latent, within the Warranty Period, Bucks™ shall have no further liability or obligation to Buyer there of.  In no event shall Bucks’™ liability under this warranty exceed original purchase price of the products, which are subject of a proper notice of defects.

WARNING – No modifications or alterations may be made to any Bucks™ equipment without the expressed written consent of the manufacturer.  Replacement of safety and instructional decals are available on request from Bucks Fabricating.

BUCKS FABRICATING, INCLUDING ITS AFFILIATES, SUBSIDIARIES AND PARENT COMPANY (COLLECTIVELY, “COMPANY”), MAKES NO WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR ANY PARTICULAR PURPOSE AND MAKES NO EXPRESS OR IMPLIED WARRANTIES IN SELLING THE PRODUCTS DESCRIBED HERE IN.  A BUYER’S RECOVERY FOR DAMAGES RESULTING FROM MANY AND ALL CAUSES WHAT-SO-EVER, INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, OR STRICT PRODUCT LIABILITY, WILL BE EXCLUSIVELY LIMITED TO THE REPLACEMENT OF THE PRODUCTS WITH RESPECT TO WHICH LOSSES OR DAMAGES ARE CLAIMED OR TO A REFUND OF ANY PURCHASE PRICE PAID FOR THE USER OF THE PRODUCTS FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES OR FOR ANY OTHER DAMAGES TO THE PROPERTY OR PERSON OF THE BUYER OR USER.
